ALASKA : Rape/Molestation Statutes of Limitation
In the state of Alaska, a person is guilty of first-degree sexual assault if:
1. the offender engages in sexual penetration with another person without consent of that person, or
2. the offender attempts to engage in sexual penetration with another person without consent of that person and causes serious physical injury to that person, or
3. the offender engages in sexual penetration with another person who is mentally incapable (for instance someone in a coma or a severe vegetative state), in the offender's care legally or through a state licensed institution (the offender can be a legal guardian or an employee at a state-licensed care facility), or
4. the offender engages in sexual penetration with a person who the offender knows is unaware that a sexual act is being committed and such an act takes place during the course of professional treatment of the victim.
First-degree rape is an unclassified felony.
A person is guilty of first-degree sexual abuse of a minor if:
1. being 16 years of age or older, the offender engages in sexual penetration with a person who is under 13 years of age or aids, induces, causes, or encourages a person who is under 13 years of age to engage in sexual penetration with another person; or
2. being 18 years of age or older, the offender engages in sexual penetration with a person who is under 18 years of age, and the offender is the victim's natural parent, stepparent, adopted parent, or legal guardian (incest); or
3. being 18 years of age or older, the offender engages in sexual penetration with a person who is under 16 years of age, and
a. the victim at the time of the offense is residing in the same household as the offender and the offender has authority over the victim; or
b. the offender occupies a position of authority in relation to the victim.
First-degree sexual abuse of a minor is an unclassified felony.
There is no statute of limitations in the state of Alaska for minors or adults who have been the victim of felony rape or felony sexual abuse.
Bob commits a felony sexual assault against Jane when she's 6 years old and she never tells anyone about it. Later, Jane decides to report the crime. Regardless of how much time has passed, Bob may still be charged with a crime.
