A person commits rape when the actor has sexual intercourse with another person without the victim's consent

A person commits rape of a child when the person has sexual intercourse with a child who is under the age of 14.

A person commits sexual abuse of a child (under 14 years of age) if, under circumstances not amounting to rape of a child, object rape of a child, sodomy upon a child, or an attempt to commit any of these offenses, the actor touches the anus, buttocks, or genitalia of any child, the breast of a female child, or otherwise takes indecent liberties with a child, or causes a child to take indecent liberties with the actor or another with intent to cause substantial emotional or bodily pain to any person or with the intent to arouse or gratify the sexual desire of any person regardless of the sex of any participant.

A person commits object rape when he, without the victim's consent, causes the penetration, however slight, of the genital or anal opening of another person who is 14 years of age or older, by any foreign object, substance, instrument, or device, not including a part of the human body, with intent to cause substantial emotional or bodily pain to the victim or with the intent to arouse or gratify the sexual desire of any person.

A person commits object rape of a child when the person causes the penetration or touching, however slight, of the genital or anal opening of a child who is under the age of 14 by any foreign object, substance, instrument, or device, not including a part of the human body, with intent to cause substantial emotional or bodily pain to the child or with the intent to arouse or gratify the sexual desire of any person.

A person commits sodomy upon a child if the actor engages in any sexual act upon or with a child who is under the age of 14, involving the genitals or anus of the actor or the child and the mouth or anus of either person, regardless of the sex of either participant.

These are all first-degree sexual offenses.

There is no statute of limitations for first-degree sex offenses per the 2007 general session of the Utah legislature, as long as the offense occured on or after May 5, 2003.

In 2006, Bob raped Jane. In the state of Utah, Bob can be prosecuted any time after Jane reports it to the police.

If the crime occurred prior to May 5, 2003, the limitation is 4 years from the age of majority for sexual offenses committed against a minor.

In 2001, Bob sexually abused 10-year-old Jane. Today, Jane is 16. Because the incident took place before May 5, 2003, Jane has within four years of her 18th birthday to press charges against Bob.

In general, felony sexual offenses (against adults) that occurred before May 5, 2003 have a limitation of 4 years after the commission of the act.
