U.S. VIRGIN ISLANDS : Rape/Molestation Statutes of Limitation

In the U.S. Virgin Islands, a felony has occurred when a person commits first, second or third-degree aggravated rape, or first or second-degree rape, which are defined as acts of sexual intercourse or sodomy with a person not the perpetrator's spouse:

1. who is under the age of thirteen or,

2. who is under sixteen years of age residing in the same household as the perpetrator, and force, intimidation, or the perpetrator's position of authority over the victim is used to accomplish the sexual act.

3. When the perpetrator is over the age of 18 and the victim is at least 16 years-old but under 18, and there is an age difference of 5 years.

4. When the victim is incapable of giving consent to the act, whether through disability or unsoundness of mind, either temporary or permanent (regardless of the age of the victim)

5. when the victim's resistance is forcibly overcome (regardless of the age of the victim)

6. when the victim's resistance is prevented by fear or intimidation (the assailant threatens to kill or harm the victim)

First-degree unlawful sexual conduct is also a felony offense, and they are defined as sexual contact with a person not the perpetrator's spouse:

1. when force or coercion is used to accomplish the sexual contact,

2. when the victim is under 13 years of age,

3. when the victim is 16 years of age residing in the same household as the perpetrator and force, intimidation, or the perpetrator's position of authority over the victim is used to accomplish the sexual act.

4. when the victim's ability to consent to or resist the contact is has been substantially impaired by intoxicants, narcotics or anesthetics (alcohol or drugs, etc)

5. when the victim is mentally incapable of consent or is physically helpless or incapacitated (mental retardation, coma, unconsciousness, etc)

There is no statute of limitations for the prosecution of felonies in the U.S. Virgin Islands.

Bob rapes Jane. Bob can be prosecuted at any point for his actions.
